BNSF Train Incident Investigation Complete

FOR IMMEDIATE RELEASE
Date: October 22, 2026
Issuing Agency: Office of Sheriff Thomas Boyer, Valley County Sheriff's Office

FINAL UPDATE: BNSF TRAIN INCIDENT - TAMPICO, MONTANA - INVESTIGATION COMPLETE

The Valley County Sheriff's Office and BNSF Police are issuing this final statement to announce the conclusion of the investigation into the incident reported on the evening of October 20, 2026, involving a BNSF train crew in the Tampico area.

FINDINGS

The investigation has determined that the two individuals present near the railroad that evening were engaged in a lawful activity — spotlighting and shooting varmints. The shot or shots fired were not directed at the train or its crew. This was a misunderstanding on the part of the BNSF crew, who reasonably but incorrectly believed they were being targeted. No malicious intent was established. No charges will be filed.

Both individuals came forward promptly and voluntarily following the initial press release, cooperated fully with investigators, and were forthright throughout the process. Their cooperation is acknowledged and appreciated.

Sheriff Boyer took the opportunity to remind both individuals of the importance of firearm safety and situational awareness. Shooters have a responsibility to be conscientious of their surroundings, including proximity to public areas, roadways, rail corridors, and locations where other people may be present. The basic rules of firearm safety exist for good reason and apply in every situation.

INVESTIGATION STATUS

The investigation into this matter is officially closed. Both the Valley County Sheriff's Office and BNSF Police consider this matter resolved.
